In accordance with article 22, paragraph 3, of the Convention, the Committee transmitted the complaint to the State party on 11 April 2001. Pursuant to rule 108 of the Committee’s rules of procedure, the State party was requested not to expel the complainant to Libya pending the consideration of his case by the Committee. The State party confirmed in their submission of 12 June 2001, that the complainant will not be expelled while his complaint is pending.

Decision concerning admissibility and examination of the merits

The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the removal of the complainant to Libya would not constitute a breach of article 3 of the Convention.
