The author of the communication is V.K., a national of Belarus. He alleges that, by extraditing him to Belarus, the State Party would violate his rights under article 7 of the Covenant.

On 5 October 2022, pursuant to rule 94 of its rules of procedure, the Committee, acting through its Special Rapporteurs on new communications and interim measures, requested the State Party to refrain from removing the author to Belarus while the communication was pending before the Committee.

On 19 April 2023, the State Party submitted its observations on the admissibility and the merits of the communication, which were transmitted to the author on 24 July 2023.

¶4.

On 30 October 2024, a reminder was sent to the author to submit his comments on the State Party’s observations. The author was informed that, in the absence of a response by 30 December 2024, the communication might be discontinued.

On 30 October 2024, the author’s counsel confirmed receipt of the reminder, but did not provide comments on the State Party’s observations.

On 16 March 2026, the Committee, in the light of the fact that no substantive response had been received and that contact with the author had apparently been lost, decided to discontinue its consideration of communication No. 4228/2022.
