The author of the communication is a national of Afghanistan. She claimed that, by deporting her to Greece, the State Party would violate her rights under articles 2, 6 and 7 of the Covenant.
On 10 November 2022, pursuant to rule 94 of its rules of procedure, the Committee, acting through its Special Rapporteurs on new communications and interim measures, requested the State Party to refrain from removing the author to Greece while her case was pending before the Committee. In view of the fact that the State Party indicated it had not received that request, it was resent to the State Party on 22 December 2022.
On 15 February and 22 June 2023, the State Party submitted its observations on the admissibility and the merits of the communication. On 22 June 2023, the author informed the Committee that new domestic asylum proceedings were under way. On 20 October 2023, the author submitted comments on the State Party’s observations. On 20 December 2023, the State Party submitted additional observations.
On 12 November 2025, the State Party informed the Committee that, since the author had given birth to a child in Finland on 28 July 2025, on 8 October 2025, the Finnish Immigration Service had granted her a continuous residence permit on humanitarian grounds (type A permit), pursuant to section 52 of the Aliens Act, valid for one year from the date of the decision. On 31 October 2025, the Finnish authorities informed the author of that decision. The State Party requested discontinuance of the communication, given that the author was no longer at risk of deportation to Greece. On 13 November 2025, the author agreed to the discontinuance of the communication.
On 16 March 2026, the Committee, in the light of the fact that the author had been granted a residence permit and was no longer at imminent risk of deportation, decided to discontinue its consideration of communication No. 4240/2022.
