The communication dated 17 January 2023 was submitted by S.R., a French national, born in 2001. At the time of the submission of the communication, the author was incarcerated in Morocco as part of extradition proceedings initiated by the Government of the United States. The author claimed that by extraditing him to the United States, the State Party would violate his rights under articles 7 and 14 3(b) of the Covenant. The author is represented by counsel.
On 25 January 2023, the author was extradited to the United States. On 31 January 2023, the Committee registered the communication and requested the State party to take interim measures to suspend the extradition, without knowing that it had already taken place. On 9 February 2023, the State Party informed the Committee that the extradition had preceded the Committee’s request for interim measures.
On 13 October 2023 and 16 February 2024, the State party submitted observations on the admissibility and merits of the communication. On 9 April 2025, the State Party's observations were transmitted to the author's counsel for comments.
On 16 June 2025, a reminder was sent to the author's counsel to submit his comments on the State Party's observations by 18 August 2025. Counsel was informed that, in the absence of a response, consideration of the communication could be terminated.
In view of the fact that no response was received and that contact with the author was apparently lost, the Committee decided at its 145th session on 16 March 2026 to discontinue communication 4294/2023.
